These Terms of Service (ToS) govern the use of the DareDaddy platform at www.daredaddy.app and all related services offered by Sparkules UG (haftungsbeschränkt), Nordhauser Straße 28, 10589 Berlin, Germany.
Deviating, conflicting, or supplementary terms of the user do not become part of the contract unless DareDaddy expressly agrees to their validity in text form.
Other offers of Sparkules UG remain unaffected by these ToS.
§ 2 Description of Services
DareDaddy provides a platform for co-creative content where registered Creators can embed livestreams (e.g., from Twitch) and start “Sessions.”
Viewers (“Community”) can create so-called “Dares” (challenges) within these Sessions and attach the virtual platform currency “Creds” to them.
The Creator can accept Dares. The community then votes on whether the Dare has been fulfilled.
Successfully confirmed Dares are compensated exclusively according to a separate agreement (“Creator Agreement”) between DareDaddy and the Creator. Normal users (Community members) have no claim to compensation or refunds.
DareDaddy only provides the platform and is not a contractual party to any agreement between users and Creators.
§ 3 Registrierung & Konten
Using the platform requires registration with complete and truthful information.
Minimum age:
Community members: 16 years
Creators: 18 years (or 14 with written consent from a parent or guardian)
DareDaddy does not target or knowingly allow children under 13 to register or participate, in accordance with COPPA and comparable regulations.
Users are required to keep access data confidential and report misuse immediately.
DareDaddy is entitled to block or delete accounts in the event of violations of these ToS, reputational harm, or violations of applicable laws.
Cred balances are forfeited if an account is closed, suspended, or terminated due to a breach of these ToS.
§ 4 Creds – Platform Currency
“Creds” are a virtual platform currency that can only be used on DareDaddy.
Creds are not legal tender, not e-money under the German ZAG, non-transferable, non-tradable, and have no value outside DareDaddy.
Creds can be purchased or earned through activities on DareDaddy.
No refunds or exchanges: Once purchased, Creds will not be refunded, including in cases of account closure or inactivity. All purchases are final.
Unused Creds expire 24 months after purchase.
Prices include applicable VAT (if applicable).
DareDaddy may refuse purchases or payouts if users are located in sanctioned countries, violate anti-money laundering provisions, or engage in technical manipulation.
Users from countries subject to comprehensive trade or financial sanctions (e.g., North Korea, Iran, Syria, Cuba, Crimea/Donetsk/Luhansk regions) are prohibited from using DareDaddy.
§ 5 Dares & Content Rules
Users may only create content and Dares that comply with applicable law, these ToS, and the Community Guidelines.
In particular, the following are prohibited:
Violent, pornographic, discriminatory, or hateful content
Content inciting self-harm or health-endangering behavior
Violations of copyrights, trademarks, or personality rights
The Creator is solely responsible for reviewing Dares before accepting them.
DareDaddy may remove, restrict, or suspend content or features at any time if they violate these rules, harm the reputation of the platform, or if such action is necessary to protect the safety of the community.
§ 6 Voting & Veto Rights
The fulfillment of a Dare is determined by community voting.
DareDaddy is entitled to correct voting results in cases of obvious abuse, trolling, or technical manipulation.
In such cases, DareDaddy may withdraw, re-credit, or adjust payouts accordingly.
§ 7 Disclaimer of Liability & Assumption of Risk
Participation in Dares is at the user’s own risk.
DareDaddy assumes no liability for damages resulting from the creation, acceptance, or execution of a Dare.
Users and Creators indemnify DareDaddy from any third-party claims related to their content or actions, including reasonable legal defense costs.
DareDaddy is only liable for intent or gross negligence; liability for lost profits or indirect damages is excluded.
DareDaddy shall not be liable for events beyond its reasonable control (“force majeure”), including but not limited to natural disasters, war, pandemics, government interventions, sanctions, or internet outages.
§ 8 Takedown Procedure
Any user may report content that violates law or these ToS.
Reports must be submitted via email to info@daredaddy.app or through the internal reporting system.
DareDaddy will promptly review reports and may remove unlawful content without prior notice.
§ 9 Third-Party Integrations
DareDaddy may embed livestreams and content from external platforms (e.g., Twitch).
There is no entitlement to the availability of such integrations.
Changes or outages of external services are beyond DareDaddy’s control.
§ 10 Trademarks & Usage Rights
Users grant DareDaddy a non-exclusive right to use created content, clips, and Dares for marketing purposes. Content may not be materially distorted.
Creators grant DareDaddy extended usage rights in accordance with the Creator Agreement.
DareDaddy’s brands and logos may only be used in accordance with official brand guidelines.
Unauthorized use of the DareDaddy brand is prohibited.
§ 11 Withdrawal Exclusion
By purchasing Creds, the user expressly agrees that DareDaddy will execute the service immediately after purchase.
The right of withdrawal for digital content expires at this point (Sec. 356 (5) BGB).
Outside the EU, all purchases of Creds are final and non-refundable.
§ 12 Termination
Users may terminate their account at any time.
DareDaddy may block or terminate access in case of violations of these ToS, reputational harm, or breaches of applicable laws.
Unused Creds expire without compensation.
§ 13 Changes to the ToS
DareDaddy may amend these ToS with future effect if a legitimate interest exists.
Changes will be communicated to the user at least 14 days before they take effect.
If the user does not object before the effective date, the changes are deemed accepted.
§ 14 Data Protection
The processing of personal data is governed by DareDaddy’s Privacy Policy, available at Privacy Policy.
Data may be transferred to third countries outside the EU/EEA, provided this is done in compliance with applicable data protection laws and appropriate safeguards (e.g., EU Standard Contractual Clauses) are in place.
§ 15 Final Provisions
German law applies, unless mandatory consumer protection law in the user’s country provides otherwise.
For users, the place of jurisdiction is Berlin, Germany, to the extent legally permissible.
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
Language clause: These ToS are drafted in English. A German version may be provided for informational purposes only. In case of conflict, the English version prevails.
